We at Bachata Vida Dance Company, LLC (“Bachata Vida,” “we,” “us,” or “our”) created this privacy policy (“Privacy Policy”) because we know that you care about how information you provide to us is used and shared. Information We Collect

We collect certain information, some of which is Personal Information (or Personal Data, which is information which can be used to identify you), when you voluntarily provide it to us such as:

  • Identifiers such as first and last name, email address, username
  • Parent or guardian online contact information
  • Payment information, such as a credit card number, when you pay for the Services through our third-party payment providers PayPal and Stripe or when you purchase a gift card through our third-party provider Square
  • If you email us with questions or contact us through your account, we will collect the information you provide in those postings. We do not allow children to communicate with others on public platforms we host
  • A photograph, video, or audio file, where such file contains your or your child’s image or voice during classes

We collect information about you through our Site and the Services in several ways when you interact with the Sites and you submit your information to us directly:

  • Through our “Contact Us” page, or when you “Member Login” to your account on our Site, however, children under 13 are not permitted to create an account on our Site
  • When you sign up for texts to get 10% off in our online store or purchase a gift card or any other merchandise
  • When you contact us through our “Web Check In” portal
  • When you sign up for the Services by enrolling for yourself or your child and pay for the Services on our Site

We may also collect information from you:

Information Collected Automatically

In addition, we automatically collect certain Personal Information when you access the Site and use the Services, including:

  • Device and network identifiers such as IP address and identifiers associated with browser cookies, web beacons and similar technologies we deploy on the Services.

  • Your operating system
  • Your state and city but not your street address

Aggregated Personal Information

Analytics

Our website uses Google Analytics, a service which transmits website traffic data to Google servers in the United States. Additionally, we have also added the "anonymizeIP" code to Google Analytics on this Website. This guarantees the masking of your IP address so that all data are collected anonymously. Only in exceptional cases will the full IP address be transmitted to a Google server in the US and shortened there.

Zoom

Our online/virtual lessons will be conducted through Zoom. Zoom is a free app/online download. You will need to have this app installed in order to participate in the class. This allows everyone to see each other and the teacher to answer any questions you have while also ensuring you are dancing safely and correctly.  You will receive a link to the Zoom conference for your class in an email prior to your class. Classes will be recorded in order to allow the students to replay the classes in order to assist in learning and made available to class members. Emails Concerning Products and Special Offers

If you sign in through Google, you are authorizing Bachata Vida to collect, store, and use, in accordance with this Privacy Policy, any and all information that you agreed that Google, Inc. would provide to Bachata Vida through Google’s Application Programming Interface (“API”). Such information may include, without limitation, your first and last name, Google username, Google profile picture, headline, unique identifier and access token, and e-mail address.

If you register or visit the Site through Facebook Connect or another social media website, you are authorizing Bachata Vida to collect, store, and use, in accordance with this Privacy Policy, any and all information that you agreed that the social media website would provide to Bachata Vida through its API. We do not receive or store your passwords for your social media accounts.

INFORMATION CONCERNING CHILD ONLINE PRIVACY PROTECTION ACT (COPPA) PRACTICES

 

We strive to educate parents and kids about how to appropriately safeguard their privacy when using our Services. We are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we allow children under the age of 13 to access and/or use our Services. Personal Information

When you sign up to become a user of the Site (a “user”), you will be asked to provide us with certain Personal Information, such as your first name, last name, and email address.  When you register your child for a class, we will ask you to provide your email address, your name, and your credit card information. In this Privacy Policy, we refer to this information as “Personal Information.” We collect certain Personal Information about your child students directly from their parents or guardian when they register their child for a class. We will ask that parents or guardians provide us with the name of their child to facilitate the class. Please note that children may share information about themselves during the Services. The Services may take place over online videos in which video images and audio of the children are recorded. No information is collected directly from children until they are in the course session. Other than the online contact information required to obtain parental consent, we do not collect any Personal Information from users under the age of 13 unless the user’s parent or legal guardian has first provided us with consent for that user to use the Services and disclose Personal Information to us. If you are a user under the age of 13, please do not send any Personal Information to us if we have not obtained prior consent from your parent or guardian. If we learn we have collected Personal Information from a user under the age of 13 without parental consent, or if we learn a user under the age of 13 has provided us Personal Information beyond what we request from him or her, in order to obtain parental consent, we will delete that information as quickly as possible. Parental Consent

We obtain verifiable parental consent before collecting Personal Information from your child. In signing up for the Services, we require that you provide your credit card information in order to register your child for and pay for a class. If you do not consent, then we will not collect, use or disclose any Personal Information about your child, and your child will not be allowed to use the Services in any way.

Parent’s Rights Regarding Their Child’s Personal Information

As a parent, you have certain rights over the collection and sharing of your child’s information:

  • We will not require your child to disclose more information than is reasonably necessary to participate in the Services;
  • You may review your child’s Personal Information, direct us to delete it, and refuse to allow any further collection or use of your child’s information; and
  • You may agree to the collection of your child’s information, but still not allow us to disclose it to third parties unless that is part of our Services.

We may allow children to enter contests, sweepstakes, or other promotions, or receive a one-time communication from us. When we do that, we will collect the child's online contact information, and only this information, to enter them into the contest, and then we will only contact them when the contest ends to notify them if they have won or lost. We will then delete the online contact information we have collected. We will also collect the parent's email address to provide you with notice that your child has entered the promotion and made contact and to allow you an opportunity for you to opt your child out. We will use the collected information for the purpose of that promotion or communication, and then delete the information from our records once it is no longer required. We do not send text messages or other non-email messages (like chat) to children.

If we expect to contact a child more than once for a particular contest, we will collect the parent’s online contact information, provide the parent with direct notice of our information practices, and an opportunity to opt out.  We will not use the child’s online contact information for any other purpose and will ensure the security of the information.

At any time, you can refuse to permit us to collect Personal Information from your child and can request that we delete from our records the Personal Information we have collected. Please keep in mind that a request to delete records may lead to a termination of an account, membership, or other service. If you have any questions or concerns about our approach to children's privacy, or you want to access the data of your child, or update your child’s information, or request the deletion of your child's information, please contact us utilizing the contact information in the “How To Contact Us” section below. A valid request to delete personal information will be accommodated within a reasonable time. In addition to the foregoing, we will exercise commercially reasonable efforts to delete Personal Information belonging to children when it is no longer needed for the purpose for which it was collected.

 

Class Video Recordings

Please note that since the class will be interactive on the Zoom platform, your child may voluntarily provide information to us, such as their name, in addition to their likeness (video) and voice, as part of the instruction. As described above, we record video of students and instructors during online dance classes (“Class Recordings”). The Class Recordings are made available to attendees of the class only, and may be shared with the entire class (and their Parents) to view (the “Permitted Recipients”). We may also use Class Recordings to provide feedback to our instructors, for customer support, and for compliance purposes. We will obtain parental consent before we use any Class Recordings for promotional or other purposes. We utilize reasonable means to (i) limit the ability of instructors to create copies of the Class Recordings or to share the Class Recordings with anyone aside from Permitted Recipients, and also (ii) limit the ability of Permitted Recipients to download or re-share the Class Recordings. While we expect instructors and Permitted Recipients to abide by our standards of conduct, please note that we cannot control or monitor what such third parties ultimately do with Class Recordings, and disclaim all responsibility in that regard.
